These Terms of Service (the “Terms”) form a legally binding agreement between you and BlockMarket, Inc.(“BlockMarket”, “we”, “us” or “our”) and govern your access to and use of the BlockMarket website, storefront and related services (collectively, the “Service”). Please read them carefully. By accessing the Service you agree to these Terms.
1. Acceptance of These Terms
By creating an account, placing an order, downloading any digital good, or otherwise using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, Refund & Cancellation Policy, Cookie Policy and Acceptable Use Policy, each of which is incorporated into these Terms by reference.
If you do not agree with any part of these Terms, you must not use the Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction if that is higher, to create an account and make purchases on the Service.
- Minors below the age of majority may only use the Service under the supervision of, and with the express consent of, a parent or legal guardian who agrees to be bound by these Terms.
- A parent or guardian who permits a minor to use the Service is responsible for all activity, orders and charges made through the account.
- We may refuse service, close accounts, or cancel orders where we reasonably believe an eligibility requirement is not met.
3. Description of the Service
BlockMarket is an online digital marketplace where users can browse and purchase downloadable cosmetic game content, including character skins, blocks, items and mobs (collectively, “Digital Goods”). Prices on the Service are denominated in in-app emeralds and processed at checkout in United States Dollars (USD).
- All Digital Goods are delivered electronically as downloadable files. No physical product is shipped.
- Purchasing a Digital Good grants you a licence to use it, as described in Section 7, rather than ownership of the underlying intellectual property.
- We may add, modify, suspend or discontinue any part of the Service or any Digital Good at any time without liability to you.
4. Accounts
You may need to register an account to purchase or download Digital Goods. You agree to provide accurate, current and complete information and to keep it up to date.
- You are responsible for safeguarding your login credentials and for all activity that occurs under your account.
- You must notify us promptly at support@blockmarket.com if you suspect any unauthorised use of your account.
- We are not liable for any loss arising from your failure to maintain the confidentiality of your credentials.
5. Orders, Pricing & Payment
All payments are processed securely by our third-party payment processor, Stripe. By submitting an order you authorise us, through Stripe, to charge your selected payment method for the total amount shown at checkout, including any applicable taxes.
- Prices are listed in USD and may change at any time. The price that applies to your order is the price displayed at the moment you complete checkout.
- You are responsible for any sales tax, VAT, GST or other taxes applicable to your purchase. Where required, applicable taxes are calculated and shown at checkout.
- We do not store full payment card numbers on our servers; card data is handled directly by Stripe under its own security and privacy terms.
- We may refuse or cancel any order, including for suspected fraud, pricing errors, or breach of these Terms. If we cancel an order you have already paid for, we will refund the affected amount.
6. Digital Goods & Licence
Subject to your compliance with these Terms and full payment, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to download and use the Digital Goods you purchase for your own personal, non-commercial gameplay.
- You may not resell, redistribute, sublicense, rent, lease, or commercially exploit any Digital Good unless we have given you written permission.
- You may not remove or alter any copyright, trademark or attribution notices contained in or accompanying a Digital Good.
- The licence terminates automatically if you breach these Terms, in which case you must cease using and delete the affected Digital Goods.
7. Refunds
Because Digital Goods are delivered electronically and consumed immediately, refunds are limited. Your statutory rights, the circumstances in which a refund may be available, and how to request one are described in full in our Refund & Cancellation Policy.
8. Acceptable Use
Your use of the Service must comply with our Acceptable Use Policy, which prohibits, among other things, fraud, chargeback abuse, intellectual property infringement, unauthorised resale, scraping, distribution of malware, and any unlawful activity. Violations may result in suspension or termination of your account.
9. Intellectual Property
The Service and its original content, features, branding, layout and software are owned by BlockMarket or its licensors and are protected by copyright, trademark and other intellectual property laws.
- Nothing in these Terms transfers ownership of any intellectual property to you; you receive only the limited licence described in Section 6.
- Feedback or suggestions you submit may be used by us without obligation or compensation to you.
10. Third-Party Content & Disclaimers
BlockMarket is an independent, fan-made marketplace. We are not affiliated with, endorsed by, or sponsored by Mojang Synergies AB or Microsoft Corporation. “Minecraft” is a trademark of Mojang Synergies AB. All trademarks are the property of their respective owners.
- Block, item and texture artwork offered on the Service is original work released under a Creative Commons Zero (CC0) dedication unless otherwise stated.
- Player-created skins are submitted by community creators, who are responsible for ensuring they have the rights to the content they upload.
- If you believe content on the Service infringes your rights, contact us at support@blockmarket.com and we will review and act appropriately.
11. Disclaimers
The Service and all Digital Goods are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free, or that any Digital Good will meet your expectations or be compatible with your setup.
12. Limitation of Liability
To the maximum extent permitted by law, BlockMarket and its officers, directors, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, goodwill or other intangible losses, arising out of or relating to your use of the Service.
To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the total amount you paid to us in the three (3) months preceding the event giving rise to the claim, or (b) fifty US dollars (USD $50). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify, defend and hold harmless BlockMarket and its affiliates from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or connected with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
14. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms or if we are required to do so by law. You may stop using the Service at any time. Provisions that by their nature should survive termination — including licence restrictions, intellectual property, disclaimers, limitation of liability and indemnification — will survive.
15. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. You agree that the state and federal courts located in Delaware will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to personal jurisdiction in those courts. Nothing in this section deprives you of any mandatory consumer protections available under the laws of your country of residence.
16. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
